These Terms of Use govern your access to and use of the GeoMark website, mobile application, and related services.
By accessing or using GeoMark, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you should not use GeoMark.
1. About GeoMark
GeoMark is a GPS land measurement tool that helps users measure land area and distance on the map, place points, calculate area and length, and save projects.
GeoMark is provided for general informational, planning, and utility purposes.
2. Acceptance of Terms
By using GeoMark, you confirm that:
- you have read and understood these Terms of Use
- you agree to comply with these Terms of Use
- you are legally permitted to use the service in your jurisdiction
If you use GeoMark on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

We may update these Terms of Use from time to time.
If we make changes, we may revise the effective date above and, where appropriate, provide additional notice through the website or app.

- misuse measurement results in a misleading, fraudulent, or unlawful way
- use automated means to scrape, overload, or abuse the service
We reserve the right to suspend or restrict access if we believe the service is being misused.
5. Measurement Results and No Professional Advice
GeoMark is designed to assist with map-based and GPS-based land measurement.
Measurement results provided by GeoMark are for general informational, estimation, and planning purposes only.
GeoMark does not provide:
- legal land surveys
- certified surveying services
- engineering advice
- legal advice
- real estate advice
- professional boundary verification
You are solely responsible for how you use measurement results.
If you need legally binding, certified, or professionally verified measurements, you should consult a qualified surveyor or other appropriate professional.
6. Accuracy Disclaimer
We strive to make GeoMark useful and reliable, but we do not guarantee that measurements, calculations, maps, GPS positioning, or other outputs will always be complete, accurate, current, or error-free.
Measurement quality may be affected by many factors, including:
- GPS signal conditions
- device limitations
- map data quality
- satellite imagery quality
- user point placement
- connectivity conditions
- software limitations
You acknowledge that use of the service is at your own risk.
7. App Store and Third-Party Platforms
GeoMark may be distributed through third-party platforms such as the Apple App Store.
Your use of GeoMark may also be subject to third-party platform terms, policies, and rules.
We are not responsible for third-party platforms, third-party map services, analytics providers, hosting providers, or other external services connected to GeoMark.
8. Intellectual Property
GeoMark, including its website, app, text, branding, design, graphics, features, and related content, is owned by us or our licensors and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not:
- copy
- reproduce
- distribute
- modify
- publish
- license
- sell
- create derivative works from
any part of GeoMark without prior written permission.
9. User Content and Feedback
If you send us feedback, suggestions, ideas, or recommendations regarding GeoMark, you agree that we may use them without restriction and without any obligation to compensate you.
If the app allows you to save project names, measurement projects, or similar content, you remain responsible for the content you create and how you use it.
You agree not to submit or store content that is unlawful, abusive, infringing, or otherwise improper.

Your use of GeoMark is also subject to our Privacy Policy, which explains how we collect, use, and protect information.

11. Availability of the Service
We may change, update, suspend, or discontinue any part of GeoMark at any time, with or without notice.
We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

12. Disclaimer of Warranties
To the fullest extent permitted by law, GeoMark is provided on an "as is" and "as available" basis.
We disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of:
- merchantability
- fitness for a particular purpose
- non-infringement
- accuracy
- reliability
- availability
We do not warrant that GeoMark will meet your requirements or that results obtained from the service will be accurate or dependable for every purpose.
13. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, business opportunities, goodwill, or other intangible losses arising out of or related to your use of GeoMark.
This applies even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to GeoMark will not exceed the amount you paid, if any, to use the service during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some parts of this section may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless GeoMark and its affiliates, service providers, licensors, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your use of the service
- your violation of these Terms
- your misuse of measurement results
- your violation of applicable law
- your infringement of any rights of another party
15. Termination
We may suspend or terminate your access to GeoMark at any time, with or without notice, if we believe you have violated these Terms or used the service in a harmful, unlawful, or abusive manner.
You may stop using GeoMark at any time.
Sections that by their nature should survive termination will survive, including provisions related to intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
16. Governing Law
These Terms of Use are governed by and construed in accordance with the laws applicable in the jurisdiction in which the service operator is established, without regard to conflict of law principles.
If a dispute arises, the parties agree to attempt to resolve it in good faith before pursuing formal legal action.
Depending on your jurisdiction, you may also have mandatory consumer rights that cannot be limited by these Terms.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms of Use, together with the Privacy Policy and any other policies or legal notices posted on the website or in the app, constitute the entire agreement between you and GeoMark regarding your use of the service.
